Eventsup South Gippsland T&C's

Please let us know if you have any questions regarding the terms and conditions before confirming a booking with Eventsup South Gippsland.

 

The following is an agreement between ‘Eventsup South Gippsland’ and ‘The Client’ for the hiring of a photo booth or photo booth related equipment or services from Eventsup South Gippsland.

 

Definitions

1.1. Eventsup South Gippsland: Eventsup South Gippsland and any employees of Eventsup South Gippsland.

1.2. The Client: The person, organisation, company or other bodies which are hiring the goods and services as specified on the Booking Form.

1.3. Event date: The time and date of the event, confirmed by Eventsup South Gippsland and noted on the Booking Form.

1.4. Booking Form: The form signed by, or on behalf of, The Client specifying details of the booking.

Booking Confirmation

2.1. A booking is not confirmed until The Client returns a Booking Form, pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from Eventsup South Gippsland.

 

Payments

3.1. A non-refundable deposit of 20% of the booking cost is payable upon booking. The booking is not confirmed until the deposit has been received by Eventsup South Gippsland.

3.2. The balance of the booking cost is payable 14 days prior to the booked event date.

3.3. If the balance of the booking cost is not received more than 14 days prior to the event date, the booking will be cancelled and the client will forfeit the deposit.

3.4. If a booking is made within 14 days of the event date, full payment is due within 48 hours. If the booking is made within 7 days of the event date, full payment is due within 24 hours.

3.5. For packages less than 5 hours, if the client requests use of Eventsup South Gippsland services in excess of the time noted on the Booking Form, this will be invoiced at $200 for each additional hour.

3.6. For 5 hour packages, if the client requests use of Eventsup South Gippsland services in excess of the time noted on the Booking Form, this will be invoiced at $100 for each additional hour.

3.7. A travel surcharge of $2.50 per km over 40km applies to events further than 40km from Toora, Victoria.

3.8. Eventsup South Gippsland currently do not service events further than 65km from Toora, Victoria.

3.9. Props must be in good order at the end of the event, otherwise a charge will apply.

Access, Space, Power and Internet Requirements

4.1. The client shall ensure a safe and appropriate environment is provided for Eventsup South Gippsland to operate its equipment.

4.2. The client must ensure:
– a space of 3m x 3m or more has been organised for the photo booth setup.
– 240v power is accessible within 5m of Eventsup South Gippsland’s equipment.
– all doorways and access paths are at least 80cm wide.
– if an outdoor event, a sheltered and flat surface is made available for the set-up and power is provided within 5m.
– Wi-Fi connection for any hires that require this service.

4.3. The client is responsible for paying any charges imposed by the venue, or required to access the venue. These charges may include, but are not limited to, parking and electricity.

4.4. If The Clients’ event takes place upstairs without lift access and Eventsup South Gippsland are not informed by The Client prior to arriving at the venue, then The Client accepts that the photo booth may not be able to be set up at their event, and they will forfeit any payments made.

Social Media

5.1. Social media uploading requires a strong signal for internet connection. Eventsup South Gippsland is not responsible if your venue does not have signal, and we strongly advise The Client check this prior to their event.

5.2. Social media uploading is subject to the availability of the service itself. We have no control over any social platforms, and therefore will not be liable for any downtime or non-availability of this service.

5.3. The Client accepts responsibility for all photos shared on social media by guests at the event. Eventsup South Gippsland reserves the right to remove photos from social media.

5.4. The Client gives permission for all photos uploaded to social media to be shared by Eventsup South Gippsland on our own social media platforms and websites.

Changes and Cancellations

6.1. Requests for changes to the event date must be made in writing at least 30 days prior to the original event date. A date change is subject to availability and receipt of a new Booking Form.

6.2. All cancellations will result in the client forfeiting the deposit, however, if Eventsup South Gippsland is notified of cancellation more than 30 days prior to the event date, credit to the value of the deposit will be given to the client to use for any future booking made within 6 months of the date of cancellation.

6.3. Cancellations made within 30 days of the event date will result in the client forfeiting all payments made to Eventsup South Gippsland.

6.4. If The Client wishes to end their service earlier on the day than the agreed time, they will not receive a refund or deduction from their full payment.

6.5. Eventsup South Gippsland can cancel any booking at any time. If Eventsup South Gippsland decides to cancel a booking, all payments made will be refunded to the Client and every attempt will be made to find a replacement service to maintain the booking.

 

Damage to Equipment

7.1. In order to prevent damage to equipment, Eventsup South Gippsland reserves the right to deny service to any person.

7.2. Eventsup South Gippsland reserves the right to cease providing services, or, deny any person access to the equipment including, computers and supplies owned by Eventsup South Gippsland. Eventsup South Gippsland is not liable for any injuries or damages caused to the client or client guests, whether invited or not. Any damage or theft occurring to any equipment owned or leased by Eventsup South Gippsland because of negligent acts of the client, clients guests or any other person will result in the client being held responsible to pay for the damages or lost items. Damages may include but are not limited to alcohol spilled on equipment, kicking or knocking over of equipment, or theft of any equipment. Company will notify the client immediately upon discovery of an accident or loss.

 

Use of Images

8.1. The Client gives permission for all photos taken during the event to be used on the Eventsup South Gippsland website and other promotional material.

 

Indemnification

9.1. Eventsup South Gippsland will not be held responsible for any circumstances beyond their reasonable control. This includes, but is not limited to, equipment failure, internet outage or interruption of service, unforeseen delays at the venue, threatened or actual act of terrorism, fire, natural disaster and war.

9.2. The client agrees that in all circumstances, Eventsup South Gippsland’s liability is limited to an amount equal to the booking cost and not be liable for indirect or consequential damages.

 

Privacy

10.1 Eventsup South Gippsland will not sell your details to any third party and will take reasonable measures to ensure that your details remain confidential.

 

Any variation to these terms and conditions must be agreed to in writing by Eventsup South Gippsland.
